KunYun Terms of Service

This is the first version drafted by the platform. Items in 【】 will be completed after legal review.

Welcome to KunYun (the "Platform"). The Platform is operated by 【Operator Legal Name】 ("we" or "us") and provides content delivery network (CDN), object storage (OSS), SSL certificate management and related services (collectively, the "Services"). Please read these Terms carefully before registering, especially the clauses in bold that exclude or limit our liability. By ticking the box and completing registration, you confirm that you have read, understood and agreed to these Terms, the Privacy Policy and the Acceptable Use Policy.

1. Scope and changes

1.1 These Terms govern your use of the Services. The Privacy Policy, the Acceptable Use Policy and the service rules published in the console form part of these Terms.

1.2 We may update these Terms as required by law or by our business. Updated Terms are published as a new version and announced through the console, in-app messages or email. If you keep using the Services after the new version takes effect, you accept the updated Terms; if you do not agree, you should stop using the Services and may request to close your account.

2. Your account

2.1 You must provide true, accurate and complete registration information and keep it up to date.

2.2 Some Services, such as acceleration of domains in mainland China, require identity verification by law. You must submit truthful identity information and be entitled to submit the documents concerned.

2.3 You are responsible for keeping your account, password and two-factor authentication device secure, and for all activities under your account. If your account is compromised or at risk, change your password immediately and notify us.

2.4 Your account may only be used by you or the organization you represent. You may not lend, transfer or sell it without our consent.

3. The Services

3.1 The features, quotas and limits of the Services are as shown in the console. We keep improving the Services and may add, change or retire features, giving you reasonable notice before retiring a feature.

3.2 To provide reliable Services, we use our own facilities and third-party infrastructure (including CDN, object storage, DNS and certificate authority providers) and route traffic automatically based on network conditions. We decide which infrastructure is used and may change it at any time.

3.3 Domains accelerated in mainland China must have a valid ICP filing as required by law. If the filing becomes invalid, we may stop accelerating the domain in mainland China.

3.4 Prices, billing methods and billing cycles are as published in the console or as agreed in a separate contract.

4. Your obligations

4.1 You must comply with applicable laws, these Terms and the Acceptable Use Policy, and you are solely responsible for the content you store, transmit or distribute through the Services ("Your Content").

4.2 You warrant that you have all rights to Your Content and to the domains you accelerate, and that they do not infringe any third party's intellectual property, privacy or other rights.

4.3 You must not interfere with or disrupt the Services or other users, or circumvent the quotas, rate limits or security measures of the Platform.

5. Suspension and termination

5.1 We may, without prior notice, suspend or terminate the Services for the domains, buckets or entire account concerned, including freezing the account or banning domains, if:

  • you violate the law, these Terms or the Acceptable Use Policy;
  • we receive a request from the competent authorities, or reasonably believe that Your Content is illegal or infringing;
  • your use poses a security risk to the Services, other users or third parties; or
  • the registration or identity information you provided is untrue.

5.2 We perform necessary maintenance and upgrades that may cause short interruptions; we try to give notice in advance and minimize the impact. For interruptions caused by force majeure, failures of infrastructure providers, network attacks or other causes beyond our control, we will do our best to restore the Services but are not liable.

5.3 You may stop using the Services and request to close your account at any time. After closure or termination, we handle your data as described in the Privacy Policy. You should back up any content you wish to keep before termination.

6. Data and intellectual property

6.1 You own Your Content. You authorize us to store, cache, transmit and process Your Content to the extent necessary to provide the Services.

6.2 The software, interfaces, documentation and trademarks of the Platform belong to us or the respective right holders. You may not copy, modify, reverse engineer or use them for other commercial purposes without permission.

6.3 We collect and use your personal information as described in the Privacy Policy.

7. Disclaimers and limitation of liability

7.1 The Services are provided "as is". To the extent permitted by law, we do not warrant that the Services will meet your specific needs or be uninterrupted or error-free.

7.2 To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, including loss of profits, loss of data and business interruption.

7.3 To the extent permitted by law, our total liability under these Terms is limited to the fees you actually paid for the Services concerned in the 12 months before the loss occurred.

7.4 You shall compensate us and third parties for all losses, including reasonable legal fees, caused by your breach of these Terms or the law.
